Court grants Osagie Ize-Iyamu substituted service on APC, Obaseki

The Edo State Governor­ship Election Petitions Tribunal has granted the prayer of the Peoples’ Demo­cratic Party, PDP and its candi­date Pastor Osagie Ize-Iyamu to serve the All Progressives Con­gress and the Governor-Elect Mr Godwin Obaseki court pro­cess by substituted means.
In suit No EPT/EDS/GOV/3/2016, the tribunal sit­ting on Wednesday in Benin City, noted that the court pro­cess would be assumed served once they are pasted on the walls, or gate of the Edo APC secretariat and the residence of Obaseki.
Following the motion ex-parte filed separately by Coun­sels to Ize-Iyamu and the PDP, the tribunal Chairman, Justice Badamasi, who allowed the pe­titioners to argue the motion ex parte, outside the pre-hearing session of the court, ruled that the petitioners can serve the APC and Mr Obaseki with the petition and all other processes by substituted means.
He said: “The application is hereby granted as prayed”, because, “it falls in line with paragraph 47 first schedule of the Electoral act as amended and Sections 5(6) 5 of the High Court rules”, applicable to the tribunal.
