Former Publicity Secretary of the Peoples’ Democratic Party, Chief Olisa Metuh, on Wednesday urged the Federal High Court in Abuja to put on hold his trial and that of his company, Destra Investments Limited, over N400m allegedly received from former the National Security Adviser, Col Sambo Dasuki (rtd).
Metuh through his lawyer, Onyeachi Ikpeazu (SAN) told the trial judge, Justice Okon Abang, that the court should stay further proceedings on the matter pending the decision of the Supreme Court on the appeal he filed challenging the decision of the Court of Appeal that affirmed the ruling of the trial court on ‘No-Case-Submission’.
Ikpeazu equally disclosed that the Supreme Court had fixedNovember 3, 2017 for the hearing of the appeal and June 9, 2017 for ruling on Stay of Proceedings application filed by the defendant that was argued on March 16, 2017.
He urged the court to determine whether the Supreme Court had the powers to grant the prayers as prayed.
The defence lawyer, however, pointed out that he was aware of the provisions of the Administration of Criminal Justice Act, adding that in the instant matter before the Supreme Court, it cannot be interpreted to mean a stay of trial because the criminal trial itself is not before the Supreme Court.
