N400m Fraud ; Olisa Metuh asks Court to wait for Supreme Court’s decision

Former Publicity Sec­retary of the Peoples’ Democratic Party, Chief Olisa Metuh, on Wednesday urged the Federal High Court in Abuja to put on hold his trial and that of his company, Destra Investments Limited, over N400m allegedly re­ceived from former the Na­tional Security Adviser, Col Sambo Dasuki (rtd).
Metuh through his lawyer, Onyeachi Ikpeazu (SAN) told the trial judge, Justice Okon Abang, that the court should stay further proceedings on the matter pending the deci­sion of the Supreme Court on the appeal he filed challeng­ing the decision of the Court of Appeal that affirmed the ruling of the trial court on ‘No-Case-Submission’.
Ikpeazu equally disclosed that the Supreme Court had fixedNovember 3, 2017 for the hearing of the appeal and June 9, 2017 for ruling on Stay of Proceedings applica­tion filed by the defendant that was argued on March 16, 2017.
He urged the court to determine whether the Su­preme Court had the powers to grant the prayers as prayed.
The defence lawyer, how­ever, pointed out that he was aware of the provisions of the Administration of Criminal Justice Act, adding that in the instant matter before the Supreme Court, it cannot be interpreted to mean a stay of trial because the criminal trial itself is not before the Su­preme Court.
