The Plateau State Local Government Election Appeal Tribunal sitting at High Court 6 in Jos, on Thursday declared Chief Dan Dul Candidate of the Democratic Peoples Party (DPP) as the duly elected Local Council Chairman of Langtang North in the 25th February Local Government polls. The tribunal further nullified the election of Hon Nanmua Kumzhi of the Peoples Democratic Party (PDP) stating that he is an unlawful occupant of the Chairmanship position.
Chief Dan Dul through his lawyer S.S. Obende filed a petition challenging the declaration of Hon. Nanmua Kumzhi as Chairman of the Council by the Plateau State Independent Electoral Commission (PLASIEC).
Justice J.D. Mann had in his judgement dismissed the preliminary objection by (PLASIEC) on whether Hon. Nanmua Kumzhi was validly declared winner by the PLASIEC.
Justice Mann stated that the declaration by the chairman of PLASIEC, Mr. Peter Dalyop, was wrong on the grounds that it was based on the order of Mr. Edward Pwajok the Plateau State Attorney General and Commissioner for Justice, as PLASIEC is an independent body that has its own legal adviser where it should take its advice from. “The Plateau AG should not have been consulted because of the independence of the PLASIEC”, the tribunal held.
The Tribunal then declared Chief Dan Dul of the Democratic Peoples Party (DPP) as the duly elected by the majority of the lawful votes cast in the Langtang North Local Government election on February 25, 2014.
Justice Mann has directed PLASIEC to issue a certificate of return to Dan Dul forthwith and ordered that he should be sworn in as the duly elected chairman of Langtang North Local Government Council immediately.
